1. Introduction
Welcome to Albanian Getaways! These terms and conditions govern the relationship between Albanian Getaways (“we,” “our,” “us”) and foreign travel agencies (“you,” “your,” “partner”) that collaborate with us to bring tourists to Albania. By registering as a partner, you agree to accept these terms and conditions.
2. Registration and Partnership
- Eligibility: Only registered and licensed travel agencies are eligible to become partners.
- Acceptance: By registering on our website, you agree to these terms and conditions. A partnership agreement will be effective upon our approval of your registration.
3. Bookings and Services
- Service Provision: Albanian Getaways will arrange services including accommodation, private transfers, restaurants, and guided tours as per the agreed itinerary.
- Booking Process: All bookings must be confirmed in writing. Changes to the bookings must also be communicated in writing and are subject to availability.
- Supplier Contracts: We have established contracts with suppliers in Albania, including hotels, transfer companies, restaurants, and guides. You agree to adhere to these contracts and any specific terms related to them.
4. Payments
- Payment Terms: All payments must be made according to the invoice terms. Typically, a deposit is required at the time of booking, and the balance is due 30 days before the service start date.
- Currency: Payments must be made in Euros (EUR) unless otherwise agreed.
Late Payments: Late payments may incur interest charges as per applicable laws.
5. Cancellations and Refunds
- Cancellation by Partner: Cancellations must be communicated in writing. The following charges apply:
Individual Bookings:
-More than 30 days before the service start date: No charge.
-30 to 15 days before the service start date: Deposit (1/3 of the total amount) is non-refundable.
-Less than 15 days before the service start date: 100% of the total amount is non-refundable.
Group Bookings:
-More than 60 days before the service start date: No charge.
-60 to 30 days before the service start date: Deposit (1/3 of the total amount) is non-refundable.
-Less than 30 days before the service start date: 100% of the total amount is non-refundable. - Cancellation by Us: In the unlikely event that we need to cancel a service, we will offer an alternative or full refund of any payments made.
6. Liability and Insurance
- Liability: We are not liable for any indirect, incidental, or consequential damages arising out of the services provided. Our liability is limited to the amount paid for the specific service.
- Insurance: Both parties agree to maintain appropriate insurance coverage. You are responsible for ensuring that your clients have adequate travel insurance.
7. Responsibilities and Obligations
- Compliance: You must comply with all applicable laws and regulations, including obtaining necessary visas and travel documents for your clients.
- Client Communication: You are responsible for communicating all relevant information to your clients, including itineraries, terms and conditions, and any changes.
- Conduct: Both parties agree to act professionally and ethically at all times.
8. Dispute Resolution
- Negotiation: In the event of a dispute, both parties agree to first attempt to resolve the issue through good faith negotiations.
- Arbitration: If the dispute cannot be resolved through negotiation, it will be referred to binding arbitration in Tirana, Albania.
9. Termination
- Termination by Either Party: Either party may terminate the partnership at any time with a written notice.
- Immediate Termination: We reserve the right to terminate the partnership immediately if there is a breach of these terms and conditions.
10. Miscellaneous
- Confidentiality: Both parties agree to keep all information related to this partnership confidential.
- Governing Law: These terms and conditions are governed by the laws of Albania.
- Amendments: We reserve the right to amend these terms and conditions at any time. Changes will be communicated in writing and will take effect immediately upon posting on our website.
